Is Trip CBD drink legal in the UK? Only with qualifiers. In England and Wales, Trip’s 25mg drinks sit on the FSA public list as Validated, so the FSA proposes they stay on sale pending a novel-food decision; none is authorised. Every can must also meet the Home Office limit of 1mg of each controlled cannabinoid per container.
Three checks apply, each read by this desk from the primary source on 3 October 2026.
| Check | Source | Where | What it means for a can |
|---|---|---|---|
| Novel-food status | FSA guidance and public list | England and Wales | Listed as Validated, RP-349; not authorised |
| Controlled cannabinoids | MDR 2001, Regulation 2 | Home Office factsheet | At most 1mg of each per container |
| Intake advice | FSA guidance | England and Wales | 10mg CBD a day; 70 µg THC |
Is Trip on the FSA public list?
Yes. The FSA’s register of CBD products linked to novel food applications headed “Last updated: 13 April 2026”, lists Boost Up and Calm Down 25mg CBD drinks under TRIP/Mile High Labs Inc, application RP-349, status Validated. This desk read page one of four; the site’s THC check tabulated all four in September.
Is Trip CBD drink legal in the UK without authorisation?
The FSA’s CBD guidance, updated 28 August 2026, says CBD foods “require authorisation before they can be sold legally” and that no CBD extracts or isolates have been authorised as novel foods. In England and Wales, only list products marked awaiting evidence or validated “are proposed to remain on the market pending a decision on authorisation”. Northern Ireland follows EU rules, and Scotland falls to Food Standards Scotland. The label conditions piece covers what authorisation would change.
What does the 1mg rule mean for a Trip can?
The Home Office drug licensing factsheet, updated 3 October 2024, says pure CBD is not controlled under the Misuse of Drugs Act 1971, but CBD products containing controlled cannabinoids such as THC are Class B unless they meet the exempt-product definition in the 2001 Regulations. Each controlled drug must not exceed 1mg, measured per container, which for a drink is the can, not per dose.
How does the 10mg advice apply?
The guidance sets a provisional acceptable daily intake of 10mg CBD and a safe upper limit of 70 µg of Δ9-THC a day. A 25mg can exceeds it alone; see the 10mg maths.

Is CBD drink legal in the UK? Not in one sentence. The FSA guidance says CBD foods need novel-food authorisation and that none had been authorised; in England and Wales, listed drinks marked validated or awaiting evidence are proposed to remain on sale meanwhile. Every drink must also meet the Home Office 1mg-per-container limit on controlled cannabinoids.
The register reflects its 13 April 2026 update. CBD drinks are novel foods, not medicines. For adults.
